Who is in the class?
A class has not yet been certified, but the plaintiff has filed a complaint seeking to represent "[a]ll persons and entities who purchased a "Champion" model toilet manufactured by Defendant American Standard Companies, Inc., or its subsidiaries or affiliates, in the United States. Excluded from this Class are Defendant, its officers, directors, and employees, and any judicial official to whom this matter is assigned." Plaintiff intends to move for class certification, which would allow him to represent himself and all others in the class.
Will the lawyers charge money to represent me?
No. We will not charge money to review your case, and we will not charge any plaintiff we represent. If the case is successful, Plaintiff's Counsel will apply to the court for a fee that is a percentage of the recovery from Defendant, and also may be based on the time spent on the case, and the risk of taking on the case.
How long will the lawsuit take?
It is impossible, especially at the early stages of a class action, to anticipate how long it will take to resolve. Class actions involve several complicated and usually time-consuming stages, including motion practice and discovery. Appeals can also result in significant delays.
