Plaintiff Stephen Laney filed a proposed class action against American Standard Companies, Inc., on August 20, 2007, in the United States District Court for the District of New Jersey.
In the complaint, Plaintiff alleges that the "Champion" line of toilets, manufactured and sold by Defendant, contains several defects: a problem with the flush valve seal, which results in leaks and continuous running of water in the toilet; and a problem with the tank, which makes it wobble and leak.
Plaintiff further alleges that despite the fact that the toilet is covered by a 10-year "worry-free" warranty, Defendant has failed reimburse customers for the cost of repairs and replacement parts, or for excess water use problems due to the design defect.
Plaintiff seeks to recover for Defendant's violations of express and implied warranties, breach of contract, violation of the New Jersey Consumer Fraud Act, and recovery of unjust enrichment.
